These Terms & Conditions ("Terms") govern your access to and use of the Bahama Golf website and services, including memberships, simulator bay reservations, lessons, leagues, events, and store purchases (collectively, the "Services"), operated by Bahama Golf ("Bahama Golf," "we," "us," or "our"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, please do not use the Services.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account, purchase a membership, or make a booking. By using the Services you represent that you meet these requirements and that the information you provide is accurate and complete.
2. Accounts
Certain features, including bookings, require an account. You are responsible for maintaining the confidentiality of your sign-in credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
3. Memberships and Billing
- Memberships are offered as recurring monthly subscriptions in the tiers described on our website. Each tier includes a defined monthly allowance of simulator bay-hours.
- By purchasing a membership, you authorize us and our payment processor (Stripe) to charge your payment method on a recurring monthly basis until you cancel.
- Monthly bay-hour allowances do not roll over and reset each billing period.
- You may cancel your membership at any time; cancellation takes effect at the end of the current billing period, and fees already paid are non-refundable except where required by law.
- We may change membership pricing or benefits on prospective notice; changes will not affect the period for which you have already paid.
4. Bookings and Cancellations
- Simulator bay and lesson reservations are subject to availability and are confirmed only upon successful payment.
- Each booking reserves a specific time slot. Please arrive on time; late arrivals may result in a shortened session.
- Cancellations are permitted up to the cutoff window applicable to your booking type (12 hours before a bay reservation; 24 hours before a lesson). Within the cutoff window, bookings are non-refundable.
- We reserve the right to cancel or reschedule a booking due to equipment issues, safety concerns, or other circumstances, in which case we will offer a rescheduled slot or a refund.
5. Store Purchases
- Prices for store products are listed in U.S. dollars and are subject to change without notice.
- Orders are confirmed upon successful payment. We reserve the right to refuse or cancel any order, including for pricing errors or suspected fraud.
- Shipping, returns, and exchanges are handled in accordance with the policies communicated at the time of purchase or upon request.
6. Payments
All payments are processed securely by Stripe. By providing payment information, you represent that you are authorized to use the payment method and you authorize the applicable charges. You are responsible for any taxes associated with your purchases.
7. Acceptable Use
You agree not to misuse the Services, including by: violating any law; infringing the rights of others; attempting to gain unauthorized access to our systems; interfering with the operation of the Services; or using the facility or equipment in an unsafe, abusive, or destructive manner. You agree to follow all posted rules and staff instructions while on the premises.
8. Intellectual Property
The Services, including all content, trademarks, logos, and software, are owned by or licensed to Bahama Golf and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.
9. Assumption of Risk
Participation in golf activities and use of simulator equipment involve inherent risks. To the fullest extent permitted by law, you assume responsibility for such risks and agree to use the facility and equipment with reasonable care. Additional waivers may be required for certain activities.
10. Disclaimers
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
11. Limitation of Liability
To the fullest extent permitted by law, Bahama Golf and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Services. Our total liability for any claim will not exceed the amount you paid to us for the Service giving rise to the claim in the twelve months preceding the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless Bahama Golf from any claims, damages, liabilities, and expenses arising out of your use of the Services or your violation of these Terms.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California, and you consent to personal jurisdiction in those courts.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
